Notification of EA Decision: Banna ba Pifhu Wind Energy Facility, Eastern Cape Province

On the 04 February 2022, a Part I Application for the extension of the validity period of the Environmental Authorisation, was submitted to the Department of Forestry, Fisheries and the Environment (DFFE), in terms of Chapter 5 of the Environmental Impact Assessment Regulations, 2014 as amended.

With reference to the above-mentioned please be advised that the DFFE has decided to grant the extension of validity of the Environmental Authorisation (EA) to the Applicant, Banna ba Pifhu Wind Farm (RF) (Pty) Ltd on the 22 February 2022. The EA was issued on the 21 July 2014 and validity has now been extended to 21 July 2024. The extension of the EA validity was required to ensure that the Applicant has a valid EA during the Part II Amendment application process, in terms of Chapter 5 of the EIA Regulations, 2014 as amended. Following the appeal period as mentioned below, the Applicant is proposing amendments to the Environmental Authorisation of the Banna ba Pifhu Wind Energy Facility (WEF) and Associated Infrastructure including Grid Connection. The amendments include changes to the turbine specifications and layout; inclusion of a Battery Energy Storage System (BESS); and changes to the distribution route of the WEF and will be presented in a Part II Amendment Report which will be made available for public review and comment.

Appeal Procedures: An appeal may be filed against this decision in terms of the National Appeals Regulations, 2014. Attention is drawn to Chapter 2 of the NEMA, 1998 (as amended) under GN R 993 in Government Gazette No. 38303 dated 08 December 2014 (National Appeal Regulations, 2014), which prescribes the appeal procedure to be followed. An appellant must submit an appeal to the appeal administrator and a copy of the appeal to the Applicant, Banna ba Pifhu Wind Farm (RF) (Pty) Ltd, any registered Interested and Affected Party (I&AP) and any organ of state with interest in the matter within 20 days from the date that this notification of the decision was sent to the I&APs.
