Development of the up to 400 kV De Aar 2 South Transmission Line and Switching Station, Northern Cape Province

NOTIFICATION OF DFFE DECISION

On 27 August 2020 initial notice was given in terms of Chapter 6 of Government Notice (GN) R 983, GN R 984 and GN R 985, under EIA Regulations, 2014 (as amended) promulgated under Section 24(5) of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (NEMA) (as amended), of the application for Environmental Authorisation (EA) for the Proposed Development of the up to 400 kV De Aar 2 South Transmission Line and Switching Station (‘proposed development’), located approximately 15 to 26 km east of the town of De Aar, Northern Cape Province.

Arcus Consultancy Services South Africa (Ltd) Pty (‘Arcus’) was appointed to act as project manager and to undertake the environmental impact assessment process for Environmental Authorisation according to the National Environmental Management Act, 1998 (Act 107 of 1998 – NEMA) as amended, for the Proposed Development.

With reference to the above-mentioned application please be advised that the Department of Forestry, Fisheries and the Environment (DFFE) has decided to grant Environmental Authorisation (EA) to the Applicant, Mulilo De Aar 2 South (Pty) Ltd. The EA was issued on 10 August 2021. A copy of the EA and reasons for the decision are provided below and can be requested from Aneesah Alwie at 021 412 1529 / deaar@arcusconsulting.co.za.

Appeal Procedure: An appeal may be filed against this decision in terms of the National Appeals Regulations, 2014. Attention is drawn to Chapter 2 of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (NEMA) (as amended) under GN R 993 in Government Gazette No. 38303 dated 08 December 2014 (National Appeal Regulations, 2014), which prescribes the appeal procedure to be followed. An appellant must submit an appeal to the appeal administrator and a copy of the appeal to the Applicant, Mulilo De Aar 2 South (Pty) Ltd, any registered Interested and Affected Party (I&AP) and any organ of state with interest in the matter within 20 days from the date that the notification of the decision was sent to the I&APs by the applicant, or the date that the notification of the decision was sent to the applicant by the Department, whichever is applicable.
